1. Acceptance of Terms

By downloading, installing, or using Hermes (“the Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Hermes is a remote development tool that allows users to control a desktop development environment from a mobile device over WebSocket connections. The Service includes desktop and mobile applications, a relay server for remote connectivity, and associated integrations.

3. User Accounts and Pairing

• You are responsible for maintaining the security of your paired devices.
• Each pairing session is secured with end-to-end encryption using unique cryptographic keys.
• You must not share your pairing credentials or allow unauthorized access to paired sessions.
• You are responsible for all activity that occurs through your paired devices.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to systems, networks, or devices that you do not own or have permission to access.
• Use the Service to transmit malware, viruses, or other harmful code.
• Interfere with or disrupt the Service, relay servers, or other users’ connections.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law.
• Use the Service to mine cryptocurrency, run denial-of-service attacks, or consume excessive relay resources.
• Impersonate another person or entity while using the Service.

5. Intellectual Property

The Service, including all software, designs, documentation, and trademarks, is owned by the Hermes team and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal or commercial development purposes.

You may not:

• Copy, modify, or distribute the Service except as expressly permitted.
• Remove or alter any proprietary notices or labels on the Service.
• Use the Hermes name, logo, or branding without prior written permission.

6. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review it to understand how we handle your data.

7. End-to-End Encryption

All communication between paired devices is encrypted using end-to-end encryption. The relay server passes encrypted data but cannot read the content of your terminal sessions, file transfers, or messages.

8. Third-Party Integrations

The Service may integrate with third-party tools such as Claude CLI, GitHub, and Google Drive. Your use of these integrations is subject to the respective third-party terms of service. Hermes is not responsible for third-party service availability or data handling.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• The results obtained from the Service will be accurate or reliable.
• Any defects in the Service will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE HERMES TEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claim arising from the Service shall not exceed the amount you paid for the Service in the twelve months preceding the claim, or $50, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless the Hermes team from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

• You may stop using the Service at any time by uninstalling the applications and removing paired devices.
• We may suspend or terminate your access to the Service if you violate these Terms or engage in harmful activity.
• Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by updating the “Last Updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
